Terms & Conditions

Please read these terms carefully before using Walsh Marketing's services.

1. Agreement to Terms

By signing up for, accessing, or using any Walsh Marketing service — including LawnSlider, QuickReview, or any associated setup, hosting, or support — you agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.

These terms apply to landscaping business owners and any authorised representatives who access our services on their behalf ("you" or "the client").

2. Services Provided

Walsh Marketing provides the following services under The Landscaper Flywheel package:

  • LawnSlider: An AI-powered lead generation tool embedded on the client's website. Homeowners upload a photo of their lawn, answer questions about their preferences, and receive AI-generated renders of their garden. Their contact details are captured and delivered to the client as a lead via email and SMS.
  • QuickReview: A web-based SMS tool bookmarked on the client's phone, used to send Google review request messages to customers after job completion.
  • Setup and onboarding: Walsh Marketing handles all technical setup including embedding LawnSlider on the client's site, configuring QuickReview, setting up lead notification pipelines, and providing a walkthrough call.
  • Ongoing management: Both tools are monitored and maintained by Walsh Marketing. All SMS costs and hosting costs are covered under the monthly fee.

Walsh Marketing reserves the right to modify, improve, or update the tools at any time. We will not make changes that materially reduce the core functionality of the service without notice.

3. Fees and Payment

Setup fee: A one-time setup fee of $250 is due prior to or at the start of onboarding. This covers all technical setup, configuration, and the launch walkthrough.

Monthly fee: A recurring fee of $200 per month covers both tools, all SMS costs, all hosting costs, and ongoing management and support. Billing begins after the setup phase is complete.

Payment: Payment terms will be confirmed at onboarding. Failure to pay the monthly fee may result in suspension of the service until the outstanding balance is settled.

No hidden fees: There are no per-message SMS charges, no hosting fees, and no additional costs beyond the setup fee and monthly fee outlined above, unless additional services are agreed in writing.

4. Cancellation

There is no minimum contract period. You may cancel the service at any time by contacting Walsh Marketing at shane@walshmarketing.net.

Cancellations take effect at the end of the current billing period. No refunds are issued for partial months. The setup fee is non-refundable once onboarding has commenced.

Upon cancellation, Walsh Marketing will remove the LawnSlider embed from the client's website and deactivate QuickReview within 7 business days.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate business information required for setup, including your Google review link, website access details, and contact information.
  • Only use QuickReview to send review request messages to customers who have verbally agreed to receive them after job completion. You must not send unsolicited SMS messages.
  • Comply with all applicable laws and regulations in your jurisdiction, including those relating to SMS marketing, consumer protection, and data privacy.
  • Not attempt to reverse-engineer, copy, resell, or otherwise exploit any Walsh Marketing tool or technology.
  • Notify Walsh Marketing promptly if any lead notification pipeline stops working or if you encounter issues with either tool.

6. SMS Compliance

Walsh Marketing operates SMS messaging in compliance with applicable regulations, including the Telephone Consumer Protection Act (TCPA) where applicable.

  • SMS lead notifications are only sent to clients who have provided explicit written consent at sign-up.
  • Review request SMS messages sent via QuickReview are the responsibility of the client. By using QuickReview, you confirm that each recipient has verbally consented to receive a review request from you.
  • Recipients may opt out of SMS messages at any time by replying STOP. Opt-out requests are processed immediately and no further messages will be sent.
  • Recipients may reply HELP to receive assistance or contact information.
  • Phone numbers are never shared with third parties for marketing purposes.

7. Intellectual Property

All tools, software, designs, and content created and provided by Walsh Marketing — including LawnSlider and QuickReview — remain the sole intellectual property of Walsh Marketing. Your subscription grants you a non-exclusive, non-transferable licence to use the tools for the duration of your active subscription.

You retain ownership of your own business data, including lead information and customer details, at all times.

8. Limitation of Liability

Walsh Marketing provides its tools and services in good faith and will make reasonable efforts to ensure they function correctly and reliably. However, we do not guarantee any specific number of leads, reviews, or business outcomes.

To the maximum extent permitted by law, Walsh Marketing shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you in connection with any claim shall not exceed the total fees paid by you to Walsh Marketing in the three months preceding the claim.

9. Termination by Walsh Marketing

Walsh Marketing reserves the right to suspend or terminate your access to our services immediately if:

  • You use QuickReview to send unsolicited or non-consensual SMS messages.
  • You breach any of the client responsibilities in Section 5.
  • Payment is overdue by more than 14 days and has not been resolved after notice.
  • Your use of our tools causes legal, regulatory, or reputational harm to Walsh Marketing.

In the event of termination for breach, no refund of the setup fee or current month's subscription will be issued.

10. Changes to These Terms

Walsh Marketing may update these Terms & Conditions from time to time. The effective date at the top of this page will reflect the most recent version. Continued use of our services following any update constitutes your acceptance of the revised terms. Where changes are material, we will notify active clients by email.

11. Governing Law

These terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Irish courts, unless otherwise agreed in writing between the parties.
